Issue or Question(s) of Law – These are the main issues the court is attempting to answer. They
are usually stated in the form of a question. Use the legal language/terminology you have
learned in this course. Another way of looking for issues in a case is by defining exactly what
the court must decide. For example: “Did Mr. Doe owe a duty to John Smith for failing to
provide safe equipment? If Mr. Doe did breach this duty, did the breach directly cause John’s
ankle to be broken (the proximate cause element of negligence)?” Other examples: “Is the
waiver signed by the plaintiff valid?” “Does the Volunteer Protection Act apply in this case?” (8 points)
Defense(s) used in this case – List the defenses used and explain why/how they were used as
defense. These should be actual defenses in the case. Sometimes, the defenses are clearly stated
as defenses. At other times, you may need to reread the list of defenses discussed in the Module
and your reading assignment. (8 points)
Decision or Holding – Include the decision(s) of the court. Sample decisions:
· For the plaintiff, reversed and remanded
· Summary judgment for the defendant
· Affirmed
Explain what the decision means. For example, “affirmed” means the court agreed with the
decision of the lower court. If the case is on appeal, state here all decisions made by each
court. (7 points)
Damages awarded, if any – Explain any monetary or other damages awarded by the court to the
plaintiff, if any. (2 points)
Rationale – Summarize why the court made the decision that it made. Use your own words. You
must explain the rationale for each of the issues identified above. For example, “Mr. Doe did
not owe a duty to John Smith because Smith was a trespasser.” (5 points)
State your beliefs – In this section, state whether you agree or disagree with the court’s decision
and explain why you agree or disagree. Make your point(s) based on sound rationale. Use your
own words and not the wording of the court, so that I know you understand the case. (7 points)
Grades will be based on correctness of information, depth of analysis, understanding
displayed, and good writing.
