America and the international criminal court
There is mass violation of human rights by the United States of America which sometimes involves severe brutality, yet there is no prosecution for those found with grave crimes. This implies a flaw in its internal judicial system. The US needs to cooperate with the international criminal court so as to aid in its judicial system. American involvement in the international criminal court will be of great significance to the court and America itself. The stand off between the United States and the international criminal court should be resolved. From my point of view, America obligates to a rule of law, justice and fairness and international treaties, while when crimes such as torture and murder happens, the US is not ready to investigate and offer prosecution to its citizens, in such situation the intervention of the international criminal court is required so as the guilty are brought to justice. The failure in their local judicial systems implies that America should cooperate with the international criminal court to facilitate justice and fairness.
Differences between judicial independence and impartiality
Judicial independence is a judicial system where by the judiciary and the judicial processes are separated from other arms of the government. Judicial impartiality is a judicial system where jurisdiction uses the principle of fairness without any bias on a particular side. Adjudication must always be based on the principle of fairness and impartiality. Personally judicial impartiality is a more fair way delivering judgment. It is not biased in any form and judgment is based on the facts put on the table. Judicial independence enjoys lack of interferences from other government institutions, the only challenge with it is that the judiciaries sometimes tend to misuse the power bestowed to them. The principle of impartiality does not necessarily imply that all individuals are offered the same treatment in any situation, people are treated differently if they merit differently. Another difference between them is that in impartial principle of justice, an outcome of judgment of one person does not affect any other individual. From my point of view, judicial impartiality is more important than judicial independence.
Political advantages for supporting crime policies that calls for the increased use of incarceration
The crime policies favoring incarceration have increased in the recent past. The increase in incarceration reports a tremendous drop in crime. Therefore it serves as the effective policy that fights crime in a given society. One of the benefits that come with increased incarceration is that the society remains peaceful in that the criminals are sent to jail for longer terms while those remaining keep off crime in fear of incarceration too. The way people view incarceration has changed from rehabilitation to deterrence and retribution. The increased incarceration has resulted in an increase in fear of crime among the public, the economic prosperity that came with incarceration has created a criminal jurisdiction system that detains individuals who have never been imprisoned or have never been to jail due to violent crimes.
The only justification towards incarceration of a large population of the Americans is that it is accompanied with reduced crime rates. The challenges that come with increased incarceration policies is the possibility of unintended results, it is associated with unemployment, which in turn may heighten more crimes in future.
